Welcome to FOVIER.

FOVIER is operated by Ivy Innovation Media LLC. Throughout these Terms of Service, the terms “FOVIER,” “we,” “us,” and “our” refer to Ivy Innovation Media LLC, doing business as FOVIER.

FOVIER operates this website and online store, including all related content, features, customer accounts, products, tools, and services collectively referred to as the “Services.”

Our store is hosted by Shopify, which provides the e-commerce platform that enables us to offer the Services to you.

These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, and any other policies referenced on our website, govern your access to and use of the Services.

By visiting our website, creating an account, placing an order, or otherwise using the Services, you agree to these Terms of Service. If you do not agree, you must not access or use the Services.

Nothing in these Terms limits any consumer right that cannot legally be waived or excluded.

SECTION 1 — ELIGIBILITY AND CUSTOMER ACCOUNTS

By using the Services, you represent that you are at least the age of majority in your state, province, territory, or country of residence.

When creating an account or placing an order, you agree to provide accurate, current, and complete information, including your name, email address, billing information, shipping information, and payment details.

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

You may not sell, transfer, assign, or provide your customer account to another person.

We may suspend or terminate an account that contains false information, has been compromised, is used fraudulently, or violates these Terms.

SECTION 2 — PRODUCTS AND PRODUCT INFORMATION

FOVIER offers women’s fashion products, including dresses, vacation wear, going-out tops, matching sets, handbags, jewelry, accessories, and related products.

We make reasonable efforts to display product descriptions, photographs, colors, materials, measurements, prices, and availability accurately.

However, product colors and appearance may vary depending on photography, lighting, screen settings, device type, and individual display calibration.

Product photographs may include styling pieces, accessories, props, or background items that are not included with the product. The product title, description, and selected options determine what is included in your purchase.

Measurements and size guides are provided for reference. Minor differences may occur because of production methods, materials, construction, and manual measurement. Customers are responsible for reviewing the product description and size information before ordering.

We may update product descriptions, prices, specifications, availability, and other information at any time. We may also limit quantities or discontinue products without prior notice.

Nothing in this section limits your rights if an item is defective, damaged, incorrect, or materially different from its description.

SECTION 3 — PRODUCT AVAILABILITY

All products are subject to availability.

Adding an item to your shopping cart does not reserve it or guarantee that it will remain available.

Inventory may become unavailable because of simultaneous purchases, inventory synchronization delays, damaged inventory, fulfillment restrictions, or technical errors.

We may limit purchase quantities per customer, account, household, billing address, shipping address, or payment method.

Unless approved by us in writing, products purchased from FOVIER are intended for personal or household use and not for commercial resale.

SECTION 4 — ORDERS AND ACCEPTANCE

Submitting an order constitutes an offer to purchase the selected products under these Terms.

An automated order confirmation means that we received your order. It does not necessarily mean that your order has been accepted or approved for fulfillment.

We may review, hold, decline, or cancel an order when reasonably necessary, including if:

  • A product is unavailable;
  • Product or pricing information is incorrect;
  • Payment authorization fails;
  • Fraud or unauthorized activity is suspected;
  • The order exceeds purchase limits;
  • The shipping address is incomplete, inaccurate, unsupported, or undeliverable;
  • We cannot verify information associated with the order; or
  • Processing the order would violate applicable law or these Terms.

If we cancel an order after collecting payment, we will issue an appropriate refund to the original payment method.

We will attempt to contact you using the information submitted with the order.

You are responsible for reviewing your product, size, color, quantity, price, shipping method, and delivery address before completing checkout.

SECTION 5 — ORDER CANCELLATIONS AND CHANGES

Customers may request cancellation within 15 minutes after placing an order, provided that the order has not already entered processing or fulfillment.

A cancellation is not complete until FOVIER confirms that the order has been cancelled.

After the 15-minute cancellation period, you may contact us at fovierofficial@gmail.com. We will make reasonable efforts to assist, but we cannot guarantee cancellation or modification after an order has:

  • Entered processing;
  • Been submitted to our fulfillment team;
  • Been packed;
  • Been transferred to a carrier; or
  • Been shipped.

Once an order has shipped, it cannot be cancelled and must be handled under our Return and Refund Policy.

For security reasons, we may decline an address change or require the original order to be cancelled and replaced.

SECTION 6 — RETURNS, REFUNDS, AND EXCHANGES

All returns and refunds are governed by our Return and Refund Policy, which forms part of these Terms.

Eligible customers may request a return within 14 calendar days from the date the item is marked as delivered, subject to the conditions and exclusions stated in our Return and Refund Policy.

Customers must obtain return instructions before sending merchandise back.

For returns resulting from sizing, fit, color preference, change of mind, or another personal preference, the customer is responsible for arranging and paying for return shipping unless applicable law requires otherwise.

FOVIER does not charge a standard restocking fee.

We do not currently provide direct exchanges through the standard return process. Customers seeking another size, color, or product should return the eligible original item and place a separate order.

Nothing in this section limits rights relating to defective, damaged, incorrect, or nonconforming goods.

SECTION 7 — PRICES, CURRENCIES, AND PROMOTIONS

Prices, discounts, promotions, and availability may change without prior notice.

The price charged will generally be the price displayed when the order is submitted, subject to correction of obvious errors and applicable law.

Prices may be displayed in different currencies depending on your location or selected market. Your bank or payment provider may impose currency conversion charges, foreign transaction fees, or other fees that are not controlled by FOVIER.

Unless expressly stated otherwise, displayed product prices do not include:

  • Shipping charges;
  • Expedited delivery charges;
  • Customs duties;
  • Import taxes;
  • Brokerage fees;
  • Carrier handling charges; or
  • Other third-party charges.

Promotions may have separate eligibility requirements, expiration dates, exclusions, geographic restrictions, purchase minimums, and usage limits.

Discount codes must generally be entered before checkout is completed. They cannot normally be applied retroactively, exchanged for cash, or combined with other promotions unless expressly permitted.

SECTION 8 — BILLING AND PAYMENTS

You agree to provide accurate, complete, and authorized payment information.

By submitting a payment method, you represent that:

  • You are authorized to use it;
  • The information is accurate;
  • The payment provider may process the transaction; and
  • You will pay all applicable product, shipping, tax, duty, and other charges.

Payments may be processed by Shopify Payments, PayPal, card networks, digital wallet providers, banks, or other third-party processors.

We may conduct fraud screening, payment authorization, address verification, and other reasonable checks before accepting or fulfilling an order.

We are not responsible for charges imposed by your bank, card issuer, payment provider, or currency conversion provider.

SECTION 9 — SHIPPING AND DELIVERY

Shipping and delivery are governed by our Shipping Policy, which forms part of these Terms.

Processing and delivery timeframes are estimates unless expressly stated otherwise.

Delivery may be delayed because of order volume, inventory availability, payment review, carrier capacity, customs processing, weather, public holidays, transportation interruptions, government action, labor disruption, natural disasters, or other circumstances outside our reasonable control.

Customers are responsible for:

  • Providing a complete and accurate shipping address;
  • Monitoring tracking information;
  • Responding to carrier communications;
  • Providing information required for customs clearance;
  • Collecting packages when required; and
  • Paying import charges not collected at checkout.

If a package is returned because it was refused, unclaimed, undeliverable, sent to an incorrect address supplied by the customer, or rejected because required import charges were not paid, reasonable shipping, return, customs, carrier, and handling costs may be deducted from an eligible refund where permitted by law.

Risk of loss or damage passes to the customer when the order is delivered to the shipping address provided at checkout, except where applicable law provides otherwise.

SECTION 10 — CUSTOMS DUTIES AND IMPORT TAXES

International orders may be subject to customs duties, import taxes, value-added taxes, brokerage charges, customs clearance fees, and carrier handling fees.

Unless checkout expressly states that these charges have been collected by FOVIER, the recipient is responsible for charges imposed by the destination country, customs authority, carrier, or another third party.

Customs policies vary by destination, and FOVIER does not control these charges.

Refusing a shipment or failing to pay import charges does not automatically cancel the order or guarantee a full refund.

Any eligible refund may be reduced by shipping, return, customs, carrier, or handling costs where permitted by applicable law.

SECTION 11 — INTELLECTUAL PROPERTY

The Services and their content are owned by or licensed to FOVIER, Ivy Innovation Media LLC, Shopify, or their respective licensors.

Protected materials include, without limitation:

  • The FOVIER name and logo;
  • Brand slogans;
  • Product names;
  • Website text;
  • Product descriptions;
  • Photographs;
  • Videos;
  • Graphics;
  • Illustrations;
  • Packaging designs;
  • Artwork;
  • Labels;
  • Layouts;
  • Marketing materials; and
  • Website design and functionality.

You may use the Services only for personal, non-commercial shopping purposes.

Without prior written permission, you may not copy, reproduce, republish, distribute, sell, license, modify, translate, publicly display, scrape, systematically extract, or commercially exploit any part of the Services or their content.

Nothing in these Terms transfers ownership of any FOVIER intellectual property or grants an implied license.

SECTION 12 — REVIEWS AND USER CONTENT

You may submit reviews, photographs, videos, comments, suggestions, testimonials, or other content collectively referred to as “User Content.”

You retain any ownership rights you have in your User Content.

By submitting User Content to FOVIER, you grant us a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, edit, publish, distribute, and display that content for purposes including operating, improving, marketing, and promoting FOVIER and the Services.

You represent that:

  • You own or have permission to submit the content;
  • The content is not fraudulent or misleading;
  • You have disclosed any compensation or incentive associated with it;
  • It does not infringe another person’s rights;
  • It does not disclose private information without permission; and
  • It complies with applicable law.

We may remove or decline to publish content that is unlawful, fraudulent, abusive, threatening, defamatory, obscene, infringing, unrelated, misleading, or contains personal information, spam, or malicious code.

We will not remove an honest review solely because it expresses a negative opinion.

We are not required to compensate you, publish your content, maintain unsolicited submissions in confidence, or respond to every submission.

SECTION 13 — THIRD-PARTY SERVICES AND LINKS

The Services may contain tools, payment methods, applications, integrations, social media features, or links provided by third parties.

Third-party services may be governed by their own terms, privacy policies, fees, and requirements.

FOVIER does not control and is not responsible for the availability, content, security, policies, products, services, or independent acts of third parties.

You should review a third party’s applicable terms and policies before providing information or completing a transaction with that party.

SECTION 14 — RELATIONSHIP WITH SHOPIFY

FOVIER is powered by Shopify, which provides the platform used to operate the Services.

Purchases made through our store are transactions directly between you and FOVIER, operated by Ivy Innovation Media LLC.

Shopify is not the seller of FOVIER products and is not responsible for our product descriptions, product quality, order acceptance, fulfillment, shipping, returns, refunds, or customer service.

To the fullest extent permitted by law, Shopify and its affiliates are released from claims arising solely from purchases and transactions between you and FOVIER.

Nothing in this section limits rights that cannot legally be waived.

SECTION 15 — PRIVACY

Personal information collected through the Services is handled under our Privacy Policy.

Because our store is hosted by Shopify, Shopify may collect and process information relating to your access to and use of the Services to host, operate, secure, support, and improve its platform.

Information may also be processed by payment processors, carriers, customer service providers, analytics providers, advertising partners, fraud-prevention providers, and other service providers involved in operating our store.

Please review our Privacy Policy for information about the data we collect, how it is used, cookies, advertising, service providers, international processing, retention, and privacy rights.

SECTION 16 — ERRORS AND INACCURACIES

The Services may occasionally contain errors or omissions relating to product descriptions, prices, discounts, availability, shipping charges, delivery estimates, or other information.

We may correct errors, update information, or cancel an affected order at any time, including after an order has been submitted, subject to applicable law.

If we cancel an order after collecting payment, we will issue an appropriate refund to the original payment method.

You may use the Services only for lawful purposes.

You may not use the Services to:

  • Violate any law or legal right;
  • Commit fraud or make an unauthorized transaction;
  • Infringe intellectual property, privacy, or proprietary rights;

  • Impersonate another person;
  • Use payment information without authorization;
  • Transmit malware, viruses, or malicious code;

Nothing in these Terms excludes any statutory warranty, consumer guarantee, or legal right that cannot lawfully be excluded.

Except for rights that cannot be excluded and except as expressly stated by FOVIER, the website and related Services are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be available, uninterrupted, secure, error-free, or free from every harmful component.

We do not guarantee that a product will satisfy every customer’s subjective expectations regarding fit, color, style, or appearance.

Mandatory rights relating to product quality, safety, conformity, title, defects, and accurate description remain unaffected.

SECTION 19 — LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

To the fullest extent permitted by law, FOVIER, Ivy Innovation Media LLC, and our affiliates, officers, directors, employees, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from:

  • Use of or inability to use the Services;
  • Website interruptions;
  • Third-party tools or websites;
  • Loss of data;
  • Lost profits;
  • Lost revenue; or
  • Lost business opportunities.

These limitations do not restrict mandatory remedies available to consumers for purchased products.

Where liability may legally be limited, our total liability relating to a particular order will not exceed the amount paid to FOVIER for the order giving rise to the claim.

SECTION 20 — INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless FOVIER, Ivy Innovation Media LLC, Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, damages, and reasonable legal expenses arising from:

  • Your material breach of these Terms;
  • Your unlawful misuse of the Services;
  • Your violation of another person’s rights;
  • Fraudulent or unauthorized activity conducted through your account; or
  • User Content submitted by you in violation of these Terms.

This obligation does not apply to the extent a claim results from our own unlawful conduct or liability that cannot legally be excluded.

SECTION 21 — TERMINATION

You may stop using the Services at any time.

We may suspend or terminate access if we reasonably believe you have violated these Terms, engaged in fraud or unlawful activity, created a security risk, infringed another person’s rights, or exposed FOVIER or another party to legal or operational risk.

Termination does not affect accepted orders, outstanding payment obligations, rights or liabilities arising before termination, or provisions that are intended to survive termination.

SECTION 22 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, it will be enforced to the greatest extent permitted by law.

The invalid or unenforceable portion will be severed without affecting the remaining provisions.

SECTION 23 — WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a right or provision does not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy, Return and Refund Policy, Shipping Policy, promotional terms, and other policies incorporated by reference, constitute the agreement between you and FOVIER concerning the Services and purchases made through them.

SECTION 24 — GOVERNING LAW

These Terms and disputes arising from the Services or purchases from FOVIER are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

Subject to mandatory consumer rights, disputes that cannot be resolved informally will be subject to the jurisdiction of the state or federal courts located in Delaware.

Nothing in this section removes a consumer’s mandatory right to rely on applicable local consumer law or bring proceedings in a court permitted by that law.

Before beginning formal proceedings, both parties agree to make a reasonable good-faith effort to resolve the dispute informally.

SECTION 25 — CHANGES TO THESE TERMS

We may update these Terms to reflect changes to our business, products, Services, website, operational practices, or legal obligations.

The current version will be published on this page with an updated revision date.

Where required by law, we will provide additional notice of material changes.

Continued use of the Services after updated Terms take effect constitutes acceptance of the updated Terms to the extent permitted by law.
